Terms of Service

Welcome to Baly! These Terms of Service ("Terms") constitute a legally binding agreement between you ("User" or "you") and the Baly team ("we"), governing your access to and use of the Baly mobile application and its related community platforms, media feeds, and interactive features (collectively, the "Services").

Please read these Terms carefully before using the Services. By creating an account or accessing the platform, you agree to be bound by these Terms. If you do not agree, please do not download or use the Services.

1. Eligibility and Age Restrictions (18+)

Due to the interactive and public nature of its community features, Baly is only available to adult users.

• You must be 18 years of age or older to register an account or use the Services.
• By using Baly, you represent and warrant that you have full legal capacity to enter into this Agreement and are at least 18 years of age.
• If we determine that an account belongs to anyone under the age of 18, we reserve the right to immediately terminate the account and delete all related data without prior notice.

2. Service Description

Baly provides a dedicated platform for ballet enthusiasts to share artistic photography, performance videos, and written records. In addition to the public community feed, the platform offers a curated selection of premium media content. Users can unlock these premium media sections by purchasing and using standard in-app benefits.

3. Account Creation and Security

• Authentication: To prioritize user privacy, Baly uses the "Sign in with Apple" feature. You agree to maintain the security of your Apple account credentials.
• Account Responsibility: You are fully responsible for all activities, content delivery, and in-app transactions conducted using your account.

4. User-Generated Content (UGC) and EULA

As a community platform, Baly has a zero-tolerance policy for inappropriate, abusive, or harmful content. By posting text, photos, or videos ("User-Generated Content" or "UGC") on Baly, you strictly agree to the following terms:

• Prohibited Content: You may not post, upload, transmit, or share any UGC that contains nudity, pornography, hate speech, defamation, harassment, bullying, or depictions of violence or illegal activity.
• Moderation and 24-Hour Removal: We use automated filters and human moderation to monitor compliance. We reserve the right to remove or disable any UGC that violates these terms within 24 hours of discovering it or receiving a user report.
• Reporting and Blocking: This service provides built-in tools that allow users to immediately report offensive UGC and block abusive users.
• UGC License: You retain ownership of the UGC. However, by uploading content to Baly's public areas, you grant us a worldwide, royalty-free license to host and display that content solely for the purpose of operating this service.

5. In-App Purchases and Digital Features

Baly boasts an in-app ecosystem, unlocking select premium channels and exclusive media bundles through standard purchases.

• Checkout by Apple: All purchases are processed securely and exclusively through Apple's In-App Purchase (IAP) system.
• Nature of Digital Features: All premium features and unlocked benefits have no actual monetary value, do not constitute property, and are not transferable or convertible into fiat currency or equivalent under any circumstances.
• Refund Policy: All in-app purchases are final transactions. Refund processing is entirely subject to Apple App Store checkout policies and must be requested directly through your Apple ID account.

6. Interaction Security and Anti-Spam Control

To maintain a high-quality community environment and protect users from online harassment or automated bot activity, Baly has integrated automatic communication rate limiting rules into its peer-to-peer messaging features. Users must comply with these community safety agreements; any attempt to circumvent these platform integrity mechanisms will result in immediate account suspension.

7. Intellectual Property

Except for user-submitted UGC, all digital assets, platform interfaces, graphics, code, and branding within the Baly platform are the exclusive property of the Baly team. You are granted only a limited, revocable license for personal, non-commercial use.

8. Account Termination

• Termination by Us: If you violate these Terms or engage in any conduct detrimental to the community, we reserve the right to suspend or permanently terminate your account and delete your UGC without incurring any liability.
• Termination by Yourself: You may terminate this Agreement at any time through the "Delete Account" option in the application settings.

9. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with international commercial practices and applicable local laws. Any dispute arising out of or in connection with these Terms shall be settled amicably through negotiation or submitted to a court with jurisdiction over the operations of Baly Team.
